Summer Strawberry Jam - No Pectin

Bright red strawberries made into jam and used for swirling in cream cheese frosting, strawberry milkshakes, smoothies, homemade ice cream, over a freshly toasted bagel, on top of a belgian waffle, or swirled into hot oatmeal in the morning are all the reasons I had to buy fresh strawberries and make this jam. The recipe is so simple and any berry can be substituted. Blueberries will be next, then I will try a mixture of strawberries, blueberries, and raspberries. A fruit medley jam with no pectin. A simple sugar syrup is all that is used to combine with fresh fruit and a little lemon juice. A candy thermometer, pan, wooden spoon, and measuring cup is the only equipment needed and before you know it, you will be nibbling on freshly made (and still warm) strawberry jam right off the spoon.

The amount of sugar used should be altered according to how ripe the berries are. I let my strawberries ripen for a few days before using them. I froze half of the batch so that I could use frozen strawberry jam in my smoothies and strawberry shakes. Note: Change a strawberry shake into a strawberry daiquiri by adding 3 T. strawberry jam, a few whole strawberries slightly chopped, a 1/4 cup of frozen strawberry daiquiri mix, and 1/4 cup of Bacardi rum. Blend and enjoy!
For the berry jam recipe you will only need 4 ingredients:

Summer Strawberry Jam
(adapted from Bon Appetit web site)
This makes about 2 1/2 cups

Ingredients:
1 1/4 cups sugar
1/3 cup water
1 tablespoon fresh lemon juice
8 cups halved hulled strawberries (about 5 pounds)

Preparation:
Bring first 3 ingredients to boil in large saucepan over medium-high heat, stirring until sugar dissolves and brushing down sides of pan with wet pastry brush. Attach candy thermometer to sides of pan and boil syrup until thermometer registers 225°F, about 6 minutes. Mix in strawberries. Return mixture to boil, reduce heat, and simmer until jam thickens and thermometer registers 216°F, stirring occasionally, about 1 hour. Transfer jam to small bowl and cool. Cover and refrigerate.

Super quick post :: Heading out the door

Matt, I and his brother are heading out RIGHT NOW and need to make it up before dark so we can set up our campsite. Just wanted to say that I have the following orders finished and will list them Monday in my shop (I just ran out of time this afternoon):

Grateful :: Blossom for a bride

Matt, his brother, and I are leaving to head north to Hoodsport, WA over the weekend and we leave this evening. We were scrambling to find someone to water our garden after a ton of plants wilted in just 1 day with out water (we planted a ton over the holiday weekend). Anyhow, at the 11th hour last night, I asked a lovely bride I'm working with, Janene, if she could do a totally strange favor and water our garden since she and her fiance would be passing through our town while we were away. She agreed! Whew! Thank you, Janene!!! Matt and I are completely grateful - especially knowing all our hardwork won't die during the hot weather this weekend! Among some other compensation, I whipped this blossom up for her:

I like! I added it to my Etsy shop too.

If you are a bride/lady in the Salem/Portland, Oregon area that might be interested in trading for a custom hair piece in exchange for watering our garden or maybe caring for Indy this summer, shoot me an email: info@twigsandhoney.com
Matt and I will inevitably be away some weeks this summer and would love the help!

Domain Name Dispute of googblog.com With Google’s Trademark

Google came out victorious in a cybersquatting case against the owner of googblog.com. Just who owned googblog.com? A 17-year-old boy named Herit Shah from Gujarat, India. Google filed the dispute through the World Intellectual Property Organization (“WIPO”), claiming that googblog.com is confusingly similar to Google’s trademarks.

Further, Google uses ‘GOOG’ as their NASDAQ financial stock ticker since 2004. Google claims trademark rights to the term ‘Google’ as far back as 1997.

Google’s domain name dispute lawyer got Shah to admit “I was in a bad faith that i can legally keep the domain googblog.com but when i kept myself in the place of google i understood i really did very unfair to google. since two weeks i have been trying to delete the domain googblog.com, but i am unable to because godaddy has put my domain on hold, on your consent godaddy may delete the domain or unhold it. I sincerely apologise to Google for infringement, misuse of their intellectual property (GOOGBLOG.COM).”

Pre-litigation negotiations between the Google and Shah failed. Google was only victorious when it was forced to file the Complaint through WIPO. That’s why it’s critical to discuss domain name disputes early with your domain name dispute attorney. See Google Inc. v. Herit Shah

UK SUBS: Left for Dead - Alive in Holland '86 [ROIR]

Once a major player in the second British punk explosion of 1979-1980, the UK Subs still retain a cult following whose tastes never left that era. This factor, coupled with singer Charlie Harper's boundless perseverance, has enabled the UK Subs -- short for "United Kingdom Subversives" -- to outlast first-generation peers like the Clash and Sex Pistols. Never a real presence in America, Harper's profile received an unexpected boost there from Guns N' Roses' inclusion of "Down on the Farm" on its dubious punk covers album, The Spaghetti Incident. Harper's own musical history stretches to the early '70s, with combos like Charlie Harper's Free Press and the Marauders. His career is an anomaly, by any measure; how many middle-aged former hairdressers are fronting punk groups with ever-fluctuating lineups? Left for Dead reissues a cassette-only recording of a 1986 gig first taped in Holland. Immediacy is the name of the game here, a point driven home by the cover packaging ("23 Songs! 60 Minutes!") and Harper's breathless delivery; he remains a presence unto himself, even if he is the sole surviving original member onstage. The band's style is agreeably diverse within punk's bass-drum-guitar constraints, a reflection of its flirtations with melodic punk (Another Kind of Blues(X), 1979), glossy experimental pop (Endangered Species, 1981), and primal proto-metal (Flood of Lies, 1984). Songs aim darts at cops ("CID," "New York State Police"), broken romance (the affecting "Fear of Girls"), rock biz hypocrisy ("Limo Life"), nuclear holocaust ("Warhead"), and homelessness (the sardonic "I Live in a Car"). The crowd howls along to every chorus, supplying an atmosphere airbrushed from the standard artfully dubbed live album. So do Big Takeover editor Jack Rabid's liner notes, which could have stood some updating (even while they cheerfully recount that Harper led three completely different bands in the years before Left for Dead's release). The UK Subs' persistence is unlikely to change the big-time rock scene, let alone their lowly cult stature, but punk fans will find plenty of delights here.

IN MY EYES: [1998] The Difference Between [REVELATION]

Boston hardcore quintet In My Eyes was formed in early 1997 by vocalist Sweet Pete, guitarists Jeff Neumann and Anthony Pappalardo, bassist Damian Genuardi and drummer Luke Garro. Signing to Revelation, the band issued their debut effort The Difference Between in 1998; Nothing to Hide followed two years later. In My Eyes is one of the few bands in the hardcore world that is creating new sounds and reviving a genre that has seen little change over the past decade. A professed Straight Edge band, In My Eyes takes positive messages, interweaves it into their heavy handed guitar tracks. "Why is it you can ruin everything we've made with one touch? And all the effort you waste lashing out...could get something done / I'll stay focused, you stay lost, " sings Sweet Pete on "The K.O.S.T." Anthony Pappalardo and Neil St. Clair add distorted rhythm along with a range of experimental guitar work, while bassist Damian Genuardi quietly lays down a foundation of basslines for the rest of the band to build on. In My Eyes is part of a new crop of hardcore bands that are reenergizing the genre. No longer are groups coming strictly from New York circuits. Instead bands are coming from all over the country, and they're offering a unique take on the classic style of hardcore.

12 CENTS FOR MARVIN: [2001] King of the Ring [CD BABY]

Twelve Cents for Marvin was formed by a group of Colorado State University students in Ft. Collins, CO, in late 1996 and early 1997. According to the liner notes of their debut album, the band got its unusual name when they went to Denver to see a concert and it was canceled. Walking around Denver, they came upon a vagrant named Marvin, who insisted they give him 12 cents. Twelve Cents for Marvin has a unique sound. It's as if a psychedelic band like Love invited a ska-tinged horn section to play for them. Their versatile instrumentation allows them to perform an unusually wide variety of music most bands usually need to bring in session musicians to create.

the ERGS!: [2005] Dorkrockcorkrod [WHOA OH]

Three willfully geeky guys from New Jersey who play pop-punk with speed, power, and a mighty smirk (which occasionally belies the fact they sometimes mean what they say), the Ergs (or, as they like to call themselves, "The Near-Sighted Three") came together in 2000, with Jeffrey Erg (Jeff Schroeck) on guitar and vocals, Joey Erg (Joe Keller) on bass, and Mikey Erg (Mike Yannich) on drums and lead vocals. The band wasted no time preserving their music for posterity, putting out two self-released CD-Rs in their first year as a band, but the group first attracted attention outside their peer group with the five-song Three Guys, Twelve Eyes EP, released by the Whoa Oh label in 2001. In a bid to raise their profile by being sued, the Ergs next issued The Ben Kweller EP in 2002. It borrowed the artwork from Kweller's disc EP Phone Home and featured a song poking less-than-charitable fun at the indie rock protégé. In 2003, the Ergs put out their first full-length album, Dorkrockcorkrod, which earned enthusiastic reviews in the punk press and spread word about the band outside of their home state. After an initial release on Whoa Oh, the album was picked up by Don Giovanni Records, which distributed the Ergs' next EP, 2005's Jersey's Best Prancers (whose title and artwork was a play on the 1997 Lifetime album). In 2006, the group was chosen to back Dave Parasite of The Parasites as he launched a tour to support a Parasites best-of CD, and they signed with Dirtnap Records, which scheduled the band's second full-length album, tentatively called Upstairs/Downstairs, for the spring of 2007.

NRA: Machine [GEARHEAD Recs.]
Sixth go-round for veteran Dutch punks NRA is aptly titled - first song "Why Did I Listen To You" fairly busts out of your speakers like that snarling fumetti android Ranxerox from Heavy Metal and proceeds to batter you around the room for the next fifteen tracks with a potent left-right combo of boundless energy and Black Flag/Husker Du-style hooks. But also like dear old Ranx, there's a heart bristling under that leathery hide, and you can hear it beat in frontman Aziz's war-weary vocals, and in the band's relentless drive (boosted again by Dutch engineer supreme Menno Bakker), which hasn't flagged much over its fifteen-year history. Sometimes taking a punch can be the best thing you can do to clear your head, so if the armies of faceless punk outfits have you in a haze, step up to NRA and let them clean your clock. You'll thank us for it later.

Sonia Sotomayor an Intellectual Property Attorney?

It turns out President Obama’s nominee to the Supreme Court was a partner at a firm that handled intellectual property litigation. In fact she ruled on an important copyright case, Tasini vs. New York Times, while she served as a federal judge for the U.S. District Court of the Southern District of New York. However, the case was later reversed by the appellate court and was then appealed again by the U.S. Supreme Court, in New York Times Co v. Tasini 533 U.S. 483 (2001). The case involved a claim of copyright infringement brought by freelance journalists against the New York Times and other news organizations (the “publishers”), when the publishers distributed articles written by the journalist to Lexis/Nexis, a legal database, without the permission of the journalist. The publishers claimed a privilege accorded collective work copyright owners by §201(c) of the Copyright Act.

At the District Court level, Sotomayor ruled in favor of the publishers, claiming that they were entitled to reproduce the articles within Lexis/Nexis under the protection of the collective work copyright. (The collective copyright entitles the copyright owner rights to the collection as whole, but not to the individual authored works which are separately copyrighted works). However, both the appellate court and the U.S. Supreme Court reversed Sotomayor’s decision ruling in favor of the freelance journalists.

The Supreme Court reasoned that as the articles appear in Lexis/Nexis, they do not appear as a collective work, rather “[w]hen the user conducts a search, each article appears as a separate item within the search result.” The Court further stated “the Database does not reproduce and distribute the article ‘as part of’ either the original edition or a ‘revision’ of that edition."

I had to drop everything to do a quick post...

Thank you, Elizabeth Messina!
I know I keep gushing about Elizabeth Messina, but with good reason... as talented of a photographer this lady is, she is equally kind, professional and thoughtful... and stunning! I've been seeing more of the gorgeous photos from A Lovely Workshop appearing on blogs including Style Me Pretty (go HERE, HERE, HERE and HERE), and I just love to oogle every single one. A few minutes ago, I got a UPS package... a big package. I thought, "hmm... what did I purchase recently??" When I opened the box, I found within it, a beautiful and heavy wooden box with gorgeous embellishing. I would have been giddy with just the box, but the contents just made me squeal out loud. Countless high-quality prints all wrapped in bundles with raffia, a disc from A Lovely Workshop, and an oh-so-pretty card. Elizabeth... you ridiculously sweet lady, you!

Above and beyond... this lady exceeds expecations in every way and I am so grateful to have worked with her. Thank you, thank you Elizabeth Messina!! Be sure to visit her blog, kiss the groom (I know I do everyday!). I think I need to update my website soon... expect to see more of her stunning work soon!

Few new pieces in the Etsy shop

I never have time anymore to create pieces for myself and I always kick myself when I throw on an outfit and hit the town with Matt without a perfect little topper. Over the holiday weekend, Matt and I worked the earth, hard, and got much of the front sidewalk garden finished. It took three days over a couple weekends, but it is 100% better. I'll have to take pictures soon! Anyhow, I treated myself to a couple pieces. One of my favorite current designs is Mist. I made two for myself, finally... in a lovely blush pink/champagne, and one in bright turquoise. I love them so much I threw up a couple made to order listings in my Etsy shop for others to enjoy. Click HERE to view the pink one and HERE for the turqoise version.

Remember the Miniature Vampire Killer's kit that I found via Peony :: Love blog? Well, later that day, I was showing Matt on my laptop and I was slightly sad because it had already sold. Over the weekend, Matt surprised me with it. I guess Matt read the blog post and knew I wanted it, so he snatched it up! Thank you, honey! Isn't he the cutest and sweetest?

What a silly thing... but hey, I'm prepared now... are you? You never know. Find more cute/quirky things HERE.

Sweet Melissa Sundays - Not Just Any Cherry Pie

I have been crazy busy planting flowering trees and looking forward to the sunshine filled weekends so the idea of staying inside and baking a pie was "really" hard to do. Michelle with the blog: Flourchild picked this week's dessert: Sour Cherry Pie with Pistachio Crumble. You will find the recipe in Sweet Melissa's Baking Book and at Michelle's blog. Michelle, if you are reading this, I would never go without making sure to bake the recipe when you chose it. You are one of the sweetest and giving people I know and we have only met and talked through blog messages and grouprecipe emails.

I did not have pistachios so I used hazelnuts as a replacement. My family and I are just now finding out we are not a huge pie cherry fan but pie cherries, grandparents, and love of tradition go back further then personal taste buds. I have spent many afternoons picking pie cherries from friend's trees that are falling to the ground or being eaten by birds. Do you have any idea how much frozen pie cherries cost? Outrageous! So, whenever grandma needed pie cherries, I have always been her go to granddaughter. The pie picking episodes are only 1 day long, but what a long day. 5-gallon buckets, and buckets are plural here, get picked, de-pitted, and put up into freezer bags by weight. I really do not like pitting cherries anymore but I do still look for anyone willing to let me pick free pie cherries. Grandma may not be here with me in person to enjoy the pies but I love to bake and give pies away, so the whole process works!

My fingers are about ready to fall off from typing like a mad person. This morning I learned, for the first time, how to make espresso with my new Delonghi espresso/cappuccino maker type EC155. I am not a coffee person and I am admitting out loud here that the espresso maker was purchased so I could make my own double shots of espresso for tiramisu. The recipe takes 10 double shots to create the dessert and so many friends and associates look forward to when the dessert is brought in for a treat. My sister, Rachel, is an expert on making iced Mochas, and she taught me how to make one correctly yesterday. Pour Hershey syrup to a 3 second count, followed up my pouring in a single or double shot of espresso just brewed; stir well; add 3 to 4 cubes of ice; pour in whole milk; stir again; add straw (a pretty pink one); ENJOY! I did. Very tasty. I now have the jitters.

I really LOVED how well Melissa described making a pie shell. Taken partially from Julia Child, whom she credits in the cookbook, everything is prechilled. The crust came out nice, even in my warm kitchen. Having a 2 crust recipe and being able to freeze one crust for future use is always welcome. I have a new banana cream pie recipe to try tomorrow so now I am set.

My baked pictures turned out terrible. All the caffeine from the espresso made my hands shake and I couldn't take a decent picture to save my life. The pie in the kitchen is beautiful so everyone will just have to come over and see for themselves along with trying a slice. I have Vanilla Bean ice cream waiting in the freezer to dollop on top. I might even let you help me weed, of course I will be offering everyone liquid beverages, with or without added adult flavoring =).

Thank you Michelle for your chose...BEAUTIFUL!

Obtaining Your Domain Name Back From Cybersquatters Through UDRP

A common scenario for established or new companies occurs when its primary domain name has been seized by a cybersquattor. For example, imagine your company name and trademark is “Sizaroma.” You were able to register www.sizaroma.com but later www.sizaroma.net, www.sizaromas.com, and www.sizaaromas.com were registered by someone else, probably a guy in China who in bad faith, has no intention of ever using domains. Or worse, he later puts up a competing website in bad faith with similar goods and services feeding off the goodwill that you have worked so hard to create. That my friends is a cybersquatter. So what are your options? One of the best is a Uniform Domain Name Resolution Policy proceeding (“UDRP”). A UDRP is like a streamlined litigation done with an arbitration panel, usually with the National Arbitration Forum or WIPO. A complaint is filed, and the cybersquatter is allowed a chance to respond. You do not have to serve the defendant like in a typical lawsuit. Nor is there a trial or any discovery. Further, there is no jurisdictional issues, so if the defendant is in China, a claim can still be made against him.

The net result is a transfer of the domain name. No money damages or injunction from using the trademark can be issued in UDRP, rather it's strictly about getting your domain name back. So the beauty of UDRP is that it is straight to the point, and can be completed within a few months rather than a long dragged out litigation that could last for a year or longer.

There are however other means for domain name disputes, such as filing a federal lawsuit under the Anticybersquatting Consumer Protection Act ("ACPA"), or perhaps a traditional trademark infringement lawsuit. An IP attorney would have to evaluate each scenario to determine the most appropriate method.

Bag that I must have :: Joodito on Etsy

I've long lusted over the unexpected and ultra modern designs of Joodito, on Etsy. I love visiting her shop to view all sorts of upcycled and reconstructed clothes. BUT... it's this bag that I'm really salivating over. Big, floppy, and in muted tones. Need it, want it... don't know if I even own even stuff to fill it up.

I love everything that comes out of the pretty little head of Marisa Ratliff (formerly Carta... yes, a Mrs. now!!). The logo on the top of this blog... her design! She just always gets it right and has this really refreshing and creative spin to all her work. I was so, so happy to get to know her while working with her throughout last year for pieces for her wedding. I am going to post more pictures on my website from her wedding soon, but for now, checkout all her loveliness with her hubby, Levi, on their big day earlier this year:
